Gongkwon Yusul Online Content Terms of Use

1. Ownership and Intellectual Property

All content provided in this program, including but not limited to videos, techniques, instructional structures, training systems, concepts, and materials, are the exclusive intellectual property of Gongkwon Yusul and its Founder. This content is protected under international copyright and intellectual property laws.

2. Permitted Use

The content is provided strictly for personal training and educational purposes only. Users are granted a limited, non-transferable, non-exclusive license to access and use the content for individual practice.

3. Age Restrictions and Account Security

  • 3.1 Age Limit: By creating an account and using this Service, you guarantee that you are above the age of 18, or have obtained express parental/legal guardian consent, and that all information you provide is accurate, complete, and current. Inaccurate or obsolete information may result in the immediate termination of your account.

  • 3.2 Account Responsibility: You are entirely responsible for maintaining the confidentiality of your password and account access, including restricting access to your devices. You agree to accept responsibility for any and all activities that occur under your account. You must notify the Gongkwon Yusul Academy immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Purchases, Subscriptions, and Fee Changes

  • 4.1 Payment Information: When making a Purchase, you represent and warrant that you have the legal right to use the payment method provided and that the information is true, correct, and complete. By submitting payment information, you grant us the right to provide this information to third-party payment processors subject to our Privacy Policy.

  • 4.2 Right to Refuse Orders: We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product/course availability, description or price errors, or suspicion of fraud or unauthorized/illegal transactions.

  • 4.3 Fee Modifications: Gongkwon Yusul reserves the right, at its sole discretion and at any time, to modify the fees for any courses, bundles, subscriptions, or certifications. Any fee change will become effective with reasonable prior notice to give you an opportunity to terminate before such change takes effect.

5. Refund Policy

  • 5.1 7-Day Refund Window and Non-Access Principle: Users may request a refund strictly within 7 days of the purchase date, provided that the content remains entirely unaccessed and unconsumed. Due to the digital nature of intellectual property, if any video has been played or accessed for even one (1) second, or if any training materials have been downloaded based on the system platform log, a refund is strictly and absolutely prohibited. By purchasing this program, the user acknowledges that immediate access to proprietary digital content is provided and therefore waives any right to initiate a chargeback, payment dispute, or refund request after accessing the content.

  • 5.2 Grounds for Refusal: A refund request will be strictly rejected if:

    • The request is made after the 7-day refund window has expired.

    • The user has violated any part of these Terms of Use.

    • There is evidence of policy abuse (e.g., consuming or accessing a portion of the course material and requesting a refund in bad faith to obtain an unfair advantage, in violation of the principle of good faith and fair dealing).

    • The item is a final sale, such as individualized grading/evaluation services or issued certificates.

  • 5.3 Refund Deductions and Penalties: In the highly exceptional event that a partial refund is approved and processed under the Academy's sole discretion:

    • The cost of the consumed portion of the content will be calculated and deducted based on the regular full price of the individual units, not the discounted bundle price at the time of purchase.

    • Any transaction fees, currency conversion fees, or processing fees charged by third-party payment gateways (such as PayPal or Stripe) are strictly non-refundable and will be deducted from the final refund amount.

6. Prohibited Activities

Users shall not engage in any of the following activities:

  • 6.1 Unauthorized Copying and Distribution: Copying, recording, downloading, capturing, saving, editing, translating, reprocessing, or reproducing any part of the content, and publicly disclosing, distributing, or sharing it on the internet, social media platforms (including but not limited to YouTube, Instagram, TikTok, blogs, websites), cloud storage, or with any third party without prior written consent from Gongkwon Yusul.

  • 6.2 Unauthorized Commercial and Educational Use: Utilizing Gongkwon Yusul content for instruction, seminars, online courses, paid membership programs, gym/dojang operations, or any other commercial purposes, except for instructing one's own direct students as explicitly permitted by the Association.

  • 6.3 Creation of Derivative Works: Creating derivative works, instructional materials, curricula, programs, teaching methodologies, evaluation systems, or new martial arts systems based on Gongkwon Yusul content.

  • 6.4 Imitation and Unauthorized Distribution of Techniques: Using or imitating 10 or more identical or substantially similar techniques, movements, sequences, training systems, practice methods, or instructional structures from the content, and distributing them through online platforms, video sales, or any other media without the explicit permission of the Creator and the Association.

  • 6.5 Unauthorized Platform and Program Development: Developing, operating, or supporting independent online academies, educational platforms, YouTube channels, membership services, instructor courses, or commercial educational programs by imitating the technical systems, curriculum, educational structure, training methods, promotion systems, or instructional styles of Gongkwon Yusul.

  • 6.6 Prohibition of AI Training and Data Mining: Using Gongkwon Yusul content for Artificial Intelligence (AI) training, machine learning, data collection, data scraping/mining, automated systems, digital databases, or the development of any other similar technologies.

  • 6.7 Credential Sharing: Sharing account information, passwords, or login credentials with others, or granting access rights to any third party.

  • 6.8 Multi-User and Institutional Account Sharing: Sharing or jointly using a single account among multiple individuals, groups, dojangs, schools, or institutions.

  • 6.9 Unauthorized Branding and Identity Use: Using the name, logo, trademarks, brand identity, dojang names, certification marks, qualification titles, or any other identifying elements of Gongkwon Yusul without prior written authorization.

  • 6.10 Defamation and Infringement of Reputation: Using the content for the purpose of defaming, slandering, or harming the honor, reputation, or credibility of Gongkwon Yusul, its Founder, instructors, or the Association.

  • 6.11 Establishment of Competing Businesses: Using Gongkwon Yusul content to establish, operate, or support competing martial arts organizations, educational institutions, online educational businesses, or any similar enterprises.

  • 6.12 Creation of Secondary Digital Goods: Utilizing the whole or any part of Gongkwon Yusul content to produce, sell, or distribute e-books, video courses, training manuals, online lectures, mobile applications, software, or other digital products.

  • 6.13 Commercial Sub-licensing and Transfer: Selling, renting, leasing, assigning, sub-licensing, redistributing, or otherwise commercially providing the content to any third party.

  • 6.14 Protection of Founder’s Proprietary Systems: Acknowledging that the technical systems, educational structure, training methods, curriculum, programs, instructional frameworks, promotion systems, and operational systems are the original intellectual property of the Founder of Gongkwon Yusul. Users are strictly prohibited from using these elements to develop, operate, or support independent martial arts systems, online academies, educational programs, instructor courses, or commercial ventures.

  • 6.15 Direct and Indirect Competition: Engaging in any activity that directly or indirectly establishes, promotes, or expands any business, brand, educational program, or martial arts system that competes with Gongkwon Yusul by utilizing its content.

7. Enforcement and Penalties

Violation of these terms may result in:

  • Immediate termination of access and account suspension without refund.

  • Permanent restriction from all Gongkwon Yusul programs and platforms.

  • Formal legal action under applicable international copyright and intellectual property laws.

  • Claims for damages, including financial loss and reputational harm.

8. Damages and Liability

Users agree that any violation causing harm to Gongkwon Yusul may result in liability for:

  • Direct financial damages.

  • Indirect or consequential damages.

  • Loss of business and commercial opportunities.

  • Brand, credibility, and reputational damage.

9. Ethical Responsibility

Gongkwon Yusul represents not only techniques but also philosophy and discipline. Users agree to uphold respect for intellectual property, integrity in training, and ethical conduct consistent with martial arts values.

10. Governing Law

These terms shall be governed by, construed, and interpreted in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

11. Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in Seoul, Republic of Korea, in accordance with the Arbitration Rules of the Korean Commercial Arbitration Board (KCAB). The seat of arbitration shall be Seoul, Republic of Korea, and the language of the arbitration shall be English.

12. Medical Disclaimer, Waiver & Liability Release

Martial arts training involves inherent physical risks. By accessing and using this content, the user acknowledges and assumes all risks of injury. The user hereby expressly releases and holds harmless Gongkwon Yusul Online Academy, its founder, subsidiaries, affiliates, partners, and instructors from any and all liability, claims, or demands related to any personal injury, property damage, or other loss sustained while practicing the techniques demonstrated in the content. Users are entirely responsible for ensuring they are in good health and training in a safe and appropriate environment.

13. Agreement

By accessing, registering for, or purchasing this content, the user acknowledges that they have read, understood, and expressly agree to be bound by these Terms of Use. Furthermore, the user acknowledges that immediate access to proprietary digital content is provided and therefore waives any right to initiate a chargeback, payment dispute, or refund request after accessing the content.

 

14. Student Video Submission and Licensing

By uploading, submitting, or sharing any video footage (including but not limited to grading tests, technique evaluations, or training clips) to the Gongkwon Yusul Online Academy, the user hereby grants Gongkwon Yusul Online Academy and its authorized partners a royalty-free, perpetual, irrevocable, worldwide, non-exclusive, and fully sub-licensable license to use, reproduce, modify, adapt, publish, translate, and display such video footage for educational, promotional, instructional, or marketing purposes in any media or format.
